This Agreement ("Agreement") governs the terms and conditions of use of the Evolved Girl Empowerment Program ("Program") provided by Evolved You LLC or Jacqueline Deas ("Provider"). By accessing or using the Program, you ("Recipient") agree to be bound by the terms and conditions of this Agreement.
Restrictions on Resale and Commercialization:
Recipient acknowledges and agrees that the Program, including but not limited to its materials, resources, and intellectual property, shall not be resold, distributed, or commercialized by Recipient or Recipient's organization. Recipient shall not collect any form of payment or compensation from others for access to or use of the Program.
Intellectual Property Rights:
Recipient acknowledges and agrees that all materials and resources within the Program are proprietary to Evolved You LLC or Jacqueline Deas and may not be copied, reproduced, or used in any manner without prior written consent from the Provider.
No Renaming or Repackaging:
Recipient shall not rename, rebrand, or repackage the Program or any of its components in any way. The resources, books, forms, and any other materials provided within the Program shall not be utilized for other programs without explicit authorization from the Provider.
Trademark Usage:
Recipient acknowledges and agrees that the name "Evolved Girl" and any associated logos are registered trademarks of the Provider. Recipient shall not use the name "Evolved Girl" or its logo on merchandise or in any commercial capacity without prior written consent from the Provider.
Limitation of Liability:
Recipient agrees that Evolved You LLC or Jacqueline Deas shall not be liable for any damages, losses, or liabilities arising from the administration of the Program in Recipient's school or organization. Recipient assumes full responsibility for implementing the Program as suggested in the Evolved Girl Facilitator Manual.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of [jurisdiction]. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in [jurisdiction].
Entire Agreement:
This Agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
